Rent guarantee insurance
A policy you take out yourself which, if the tenant stops paying, compensates you
afterwards: first you have to make a claim, sit out the waiting period and prove it.
It covers a set number of months' rent, not always all of them, and an empty apartment isn't covered.
Rental guarantee
A generic name for any arrangement that backs up payment: a surety, an extra
deposit, an insurance policy. What it guarantees depends on what the agreement says, within
the legal limits: in a residential lease of up to five years (seven if the landlord
is a company), the additional guarantee can't exceed two months' rent and, since
8 October 2026, one month's rent in a temporary let; and since that date the tenant can't be
required to take out rent guarantee insurance. The word on its own tells you nothing.
Guaranteed payment or guaranteed rent
Here it's the company that pays you, not the tenant. That's what we do:
we sign with you, become your counterparty and pay the same amount into your account
every month. If the apartment is empty or someone doesn't pay us, that's our problem.
Rental income insurance
Another commercial name for rent guarantee insurance. Check three things before you sign one:
how many months' rent it covers, how long its waiting period is and whether it requires a
solvency check that could rule out the tenant you already have.
The cap on the additional guarantee and the ban on requiring the tenant to take out rent guarantee insurance are in article 36.5 of the LAU (Spain's Urban Leases Act), as rewritten by article 3 of Real Decreto-ley 29/2026 (Royal Decree-law 29/2026) of 6 October. A word of warning: Real Decreto-ley 29/2026 has been in force since 8 October 2026, but the Congreso (the lower house of the Spanish parliament) must ratify it within the following thirty days, as article 86 of the Spanish Constitution requires. Its predecessor, Real Decreto-ley 26/2026, with the same title, was not ratified and was repealed on 2 October. If this one also lapsed, the previous rules would return, and we'll update this page.
